2. Our Processing Activities

Below you can read about which personal data we process about you, for what purposes, the legal basis on which we base the processing, and when the data is deleted.

A. Handling of purchases, tax calculation, and vehicle registration

  • Personal data: When you purchase a service from us, we collect standard personal data: Name, address, phone number, email address, information about your purchase, as well as specific information about your vehicle (e.g., VIN/chassis number, date of first registration, mileage, and CoC document).

  • Legal basis for processing: We process this information in order to fulfill our agreement with you to deliver the requested service (e.g., preliminary valuation or final tax calculation), cf. GDPR Art. 6(1)(b).

  • Retention period: Information related to payment and purchase is retained for 5 years from the end of the financial year to which the material relates, in order to comply with the Danish Bookkeeping Act. Information about the actual tax calculation is kept for as long as necessary to document the process to the authorities or defend against a potential legal claim.

  • Recipients: To provide our service, we disclose relevant information to public authorities, primarily the Danish Motor Vehicle Agency (Motorstyrelsen). Furthermore, information may be disclosed to authorized inspection centers if this is part of the agreement. Payment information is handled by our secure payment acquirers.

B. Valuation and offers on used cars

  • Personal data: When you use our form to get an offer on your used car, we collect your name, phone number, and email address. Additionally, we collect the car’s license plate, mileage, information about the car’s condition (equipment, damages, etc.), your desired price (if any), and the pictures you upload of the vehicle.

  • Legal basis for processing: We process this information to evaluate your car, calculate a fair offer, and contact you with the bid. The processing occurs because it is necessary in order to take steps at your request prior to entering into a potential purchase agreement, cf. GDPR Art. 6(1)(b).

  • Retention period: If you accept our offer and we purchase the car, the information is retained for 5 years from the end of the financial year to which the transaction relates, cf. the Danish Bookkeeping Act. If the inquiry does not result in a transaction, we generally delete your information and pictures after 6 months, unless there is a specific reason to keep them longer.

C. Customer service and general contact forms

  • Personal data: If you contact us via our general contact form, email, or phone, we process your name, your email address/phone number, and the information contained in your inquiry.

  • Legal basis for processing: The processing is based on our legitimate interest in being able to answer your inquiry and provide good customer service, cf. GDPR Art. 6(1)(f).

  • Retention period: We delete your inquiry once it has been processed and there is no longer a reason to keep it, unless the inquiry leads to a specific order (see section A).

D. Use of the website (Cookies)

  • Personal data: When you visit www.yupex.dk, we collect information about your behavior via cookies (e.g., IP address, browser type, and interaction on the site).

  • Legal basis for processing: Necessary cookies are placed to make the site function. Other cookies (e.g., for statistics or marketing) are only placed if you have given your explicit consent via our cookie banner, cf. GDPR Art. 6(1)(a).

3. Who do we share your information with?

In addition to the mentioned authorities (Motorstyrelsen) and partners (inspection centers) related to case processing, we sometimes entrust personal data to our IT and system providers (data processors). This applies, for example, to providers of our webshop system (WooCommerce), accounting system, and email hosting. We have entered into data processing agreements with our data processors to ensure that they solely process your information according to our instructions and comply with high standards of data security. As a general rule, we do not transfer your personal data to countries outside the EU/EEA.

4. Your Rights

According to the General Data Protection Regulation (GDPR), you have a number of rights regarding our processing of information about you:
  • Right of access: You have the right to access the information we process about you.
  • Right to rectification: You have the right to have inaccurate information about yourself corrected.
  • Right to erasure: In special cases, you have the right to have information about you deleted before the time of our normal general deletion occurs.
  • Right to restriction of processing: You have, in certain cases, the right to have the processing of your personal data restricted.
  • Right to object: You have, in certain cases, the right to object to our otherwise lawful processing of your personal data.
  • Right to data portability: You have, in certain cases, the right to receive your personal data in a structured, commonly used, and machine-readable format, as well as to have this personal data transferred from one data controller to another without hindrance.
  • Right to withdraw consent: If our processing is based on your consent (e.g., with certain cookies), you can withdraw your consent at any time.
